Terms of Service / Allgemeine Geschäftsbedingungen

1. Scope and provider

These terms govern all contracts between Johannes Kantorczyk, Landsberger Straße 185,
12623 Berlin, Deutschland / Germany ("we", "us") and the customer ("you") for
products offered via this store. They apply to consumers and businesses. We do not accept
diverging customer terms unless we agree in writing.

2. The product

We produce personalised digital memory reels: short videos created from family photographs
you supply, combining AI processing with human curation. The product is delivered digitally; there
is no physical shipment. Variants offered:

  • First Look — free sample reel (£0)
    • Keepsake — £89 · Heirloom — £149 · Legacy — £249

    Exact scope (number of photos, length, revisions) is as described on the product page at the time
    of order.

    3. Conclusion of contract

    The presentation of products is not a binding offer. By completing checkout you make a binding
    offer to purchase. The contract is concluded when we confirm the order or begin performance. For
    the free First Look, the contract is concluded when you submit the order at £0.

    4. The free First Look offer

    The First Look is a free sample. You may upload the stated number of photos and receive one sample
    reel at no charge, with no obligation to purchase. We may limit the offer to one per household and
    withdraw or change it at any time for future orders. Photos uploaded for a First Look may be reused
    toward a later paid order if you choose to upgrade.

    5. Your photos — rights, licence, and conduct

    • You warrant that you own or have all necessary rights and consents (including from people

    depicted) to upload and have us process the photos you submit.

    • You grant us a limited, non-exclusive licence to store and process your photos **solely to

    produce and deliver your reel**. We do not use your photos to train AI models or for any other
    purpose. See the Privacy Policy for retention.

    • You must not upload unlawful, infringing, or harmful content. We may refuse or stop an order that

    breaches this clause and will refund any amount paid for it.

    6. Prices and payment

    Prices are stated on the product page in the currency shown at checkout. Payment is due at order via
    the payment methods offered (e.g. card via Shopify Payments/Stripe, PayPal). *In accordance with
    § 19 UStG no VAT is charged (small-business regulation). (If VAT-registered: delete and state that
    prices include statutory VAT.)*

    7. Delivery / provision of the digital service

    We provide the finished reel digitally (e.g. via download link or email) within the timeframe stated
    on the product page (target: a few business days after we receive usable photos). Delays caused by
    missing or unusable photos are not our responsibility; we will ask you to re-supply.

    8. Right of withdrawal

    Consumers have a statutory right of withdrawal as set out in our separate Right of Withdrawal
    notice, including the cases in which that right does not apply or expires for personalised /
    digital products. The voluntary 60-day satisfaction guarantee in our Refund Policy applies in
    addition and independently.

    9. Warranty and liability

    Statutory warranty rights apply. We are liable without limitation for intent and gross negligence
    and under the Product Liability Act, and for injury to life, body, or health. For slight negligence
    we are liable only for breach of a material contractual obligation (cardinal duty) and limited to
    the foreseeable, contract-typical damage. Otherwise our liability is excluded to the extent
    permitted by law.

    10. Applicable law and dispute resolution

    German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
    For consumers this does not deprive you of the mandatory protections of the law of your country of
    residence. We are not obliged to participate in consumer arbitration proceedings (§ 36 VSBG).

    11. Severability

    If any provision is or becomes invalid, the remaining provisions stay effective.
